Mechatronics Unit Fail

Hi all.

Currently in a sticky situation. My car has had its diagnostic done and it needs a new mechatronic unit.

I bought my car back in July 2023 with 3 years warrenty. The issue is, I've now noticed the service at 40k for the transmission fluid and filter change didn't take place.

I was given the service book and noticed it had a full service every year but I missed the fact that service needed doing too. I wasn't told it hadn't been done either. I bought the car at 51k miles so it was already way past. I bought it from a reputable dealership, Carshop Northampton.

I very much doubt the warrenty will cover it because the service wasn't done. But, do you think the shop should pay for it since they sold a car that would inevitably lead to failure by missing the service and I wasn't told about it?

Hmm... I think it would be easier to argue your case if the failure happened shortly after you purchased your car. It looks like you've been driving for 2 years now (hopefully doing yearly oil and filter change) but neglected DSG. If every year you took the car to a reputable VW garage for service, they should have notified you that DSG needed servicing. For VW warranty to be valid, the car must be serviced by a qualified VW technician.

I sort of feel that you and the previous owner are equally culpable. You can try and play dumb - didn't know, never was made aware, assumed everything was previously serviced on time, etc. and see if VW dealer that sold you this car can at least partially cover the repair. Now, if you did take the car every year to be serviced by a VW garage, and they somehow missed DSG service interval, then yes, you have a good case for VW warranty to cover this failure.
